A similar thing happened to a WB rhino with an Ork Shock Attack Gun at Adepticon. He rolled two 6 sixes. The rules say that the model in question is removed from play. Vehicles take a pen. hit. We called the judge over to clarify for them for some reason.
However, the Vortex grenade removes the model and passengers form play in Apoc. It comes to that age old question: Are models embarked in vehicles in play? GW has ruled both ways. Look at the Doom of M. rule and its nonexistant effect on passengers. Look at psychic hoods for the counter argument.
If his rule says that the model who killed him is removed than this argument is moot. The transport won't be killing anybody in CC.

As a side note, the deafrolla attack wouldent trigger it, since that's in the movement phase, his only works in the assult phase

And because it may help put it into perspective, and show how it is possible, even of deemed a rules exploit:
5 man GK strike squad with a BC attached assults a 10 man Banshee squad, and star assults a falcon with eldrad inside. The banshees strike first, kill the squad, but not the BC since he is an Ic and no attacks were directed at him, and in return he nothing, since none were in base with him except the falcon and he couldent damage it with his str 4 attacks. He fails his test at -5, and the banshees manage to get higher init roll thus he doesn't get away, and is forced too take 5 saves. Being a 1 wound model, all it takes is failing 1 save and he will be removed as a casualty, and thus triggers Heroic Sacrefice. Since the only model in base contact is the falcon, he has too attack it with HS.

Hrm, aparently I missed that part, is it listed somewhere else or am I just missing it? "if the psychic test is successful, the brotherhood champion makes a single attack against one enemy model that was in base contact when he died." It says nothing about it having too be the one who killed him, otherwise it would be useless against anything but ICs or MCs running solo Thanks for the clarification, your wording in the original post I was responding to was completely different.

so I guess he could remove the transport from play, just comes to the same old thing of moving your transports so they don't get pimped by things like that.

We called the judge over to clarify for them for some reason. Yeah, that was weird. I think they saw the writing on the wall and were looking for a break on that one. As to the original topic, I'm wondering why there would be a full transport vehicle involved in an assault in most cases anyway! I'm thinking in most cases after the Deffrolla failed to kill the guy to boyz/nobz would get out and krump 'im good.
